Required Conduct
The goal of the attorney disciplinary process is to protect the public and our system of justice from the unethical conduct of attorneys. The conduct of attorneys who practice in this court must comport to the standards set forth in the Rules of Professional Conduct as adopted by the Nebraska Supreme Court.
Available Discipline
The court may discipline any attorney who is admitted to practice before the court or is admitted for a particular proceeding. Such discipline may include, but is not limited to, disbarment, suspension, public reprimand, private admonition, or sanctions. This rule does not limit the court's inherent, statutory, or other authority to control its proceedings, including through civil or criminal contempt proceedings.
How to File a Grievance
Filing a grievance against an attorney is a serious matter. However, you need not have any special legal knowledge to file one. If you believe that an attorney has behaved in an unethical manner, you may file a grievance in one of two ways. You may file directly with the Nebraska Supreme Court Counsel for Discipline or you may file with the chief judge of this court. If filed with the chief judge of this court, the chief judge will review the grievance and determine whether it should be dismissed, pursued further, or referred to the Nebraska Supreme Court Counsel for Discipline. Remember that it takes evidence of unethical conduct to justify disciplinary action against an attorney. Therefore, you should provide copies of all letters and papers which support and explain your grievance.
