IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEBRASKA IN RE: DISCLOSURE OF ) ) GENERAL ORDER 98- _____ APPROVED CJA VOUCHERS ) The following procedures are established to provide for the disclosure of amounts paid to court appointed attorneys pursuant to the Criminal Justice Act (CJA), 18 U.S.C.  3006A, upon the court's approval of the payments in accordance with Section 308, P.L. 105-119. The extent of the disclosure shall depend on whether the case is pending and whether the court has determined that certain interests delineated in 18 U.S.C.  3006A(d)(4)(D) require the redaction of certain information. This General Order shall apply to all cases filed after January 25, 1998, and shall be in effect for no longer than twenty- four (24) months after January 25, 1998. With respect to all payments approved by the court before or during trial, or while any appeal is pending, no CJA voucher forms, i.e., CJA20, CJA21, CJA30, or CJA 31, or attachments thereto shall be made public. In such cases, the Clerk of the Court shall make public only the information from the face page of the CJA voucher form showing the amounts approved for payment to defense counsel in the following categories: Arraignment and/or Plea; Bail and Detention Hearings; Motion Hearings; Interviews and Conferences; Obtaining and Reviewing Records; Legal Research and Brief Writing; Travel Time; Investigative Work; Experts; Trial and Appeals; and Other. In addition, the Clerk shall make public the name of the defense counsel for whom payment was approved and the date of the approval. No other information on the voucher shall be made public. In the event that the court has entered a separate order with respect to a case and/or a defense counsel regarding CJA vouchers pursuant to 18 U.S.C.  3006A(d)(4)C)(ii) and (D), the Clerk shall make no information on the CJA voucher form public. In any case in which the trial has been completed and any appeal is final, the Clerk of the Court shall make available to the public an unredacted copy of any voucher provided by defense counsel to justify expenses to the court unless the court has entered a separate order limiting the disclosure to protect the interests of the defendant pursuant to 18 U.S.C.  3006A(d)(4)(C)(ii) and (D). The Federal Public Defender for the District of Nebraska shall provide notice of this General Order and 18 U.S.C.  3006A(d)(4) to all CJA panel attorneys. Further, a copy of the notice attached to this General Order shall be attached to the initial CJA voucher provided to defense counsel in all cases. Such notice shall constitute the reasonable notice to counsel for the defendant under 18 U.S.C.  3006A(d)(4)(E) of the opportunity to request redaction based upon the considerations set forth in 18 U.S.C.  3006A(d)(4)(D) prior to the approval of payments.
