IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEBRASKA IN THE MATTER OF ) A LAPS IN APPROPRIATIONS ) FUNDING OPERATIONS OF THE ) FEDERAL JUDICIARY )GENERAL ORDER 95- 11 ) ) ) It is hereby found that all employees of the United States District Court for the District of Nebraska, including Bankruptcy, and the clerk's offices and of the court supporting agencies, i.e., United States probation, United States Pretrial Services, United States Federal Public Defender, United States Marshal, and General Services Administration, including maintenance personnel, are hereby needed to provide operations and services required in order to maintain and support the exercise of the judicial power of the United States in the District of Nebraska, i.e., the performance of the constitutional duty of the Court to hear and decide cases without interruption. Therefore, in the event of a lapse in appropriations by Congress for the operation of the federal judiciary. IT IS ORDERED that none of those employees will be furloughed and no services and functions of the court and of those agencies will cease or be curtailed except as required by the provisions of the Guide to Judiciary Policies and Procedures, Volume 1, Chapter III, Part C. ACCORDINGLY, IT IS FURTHER ORDERED that all cases, civil and criminal, old and new, shall be processed and argued and judgments shall be issued and enforced according to normal schedules and priorities; and all essential case supporting services, i.e., those functions necessary and essential to continue the resolution of cases, from magistrates, clerks, probation officers, pretrial officers, federal public defenders, United States Marshal, General Services Administration, and maintenance personnel and others, will be provided; however, the incurring of new obligations such as the acquisition of equipment, the hiring of new personnel, travel, etc., shall be avoided unless absolutely necessary, i.e., demonstratively essential for the resolution of cases and controversies. Agency heads are directed to comply both literally and in spirit with the provisions and requirements of the Guide to Judiciary Policies and procedures, Volume 1, Chapter III, Part C, and when in doubt, are to confer with the undersigned.
