The 2008 Eighth Circuit Judicial Conference will take place at the Chicago Marriott Downtown Magnificent Mile Hotel, Chicago, Illinois, August 13-15, 2008. The conference is a joint meeting of the lawyers and judges, all of whom are encouraged to register now.

Important Information from the United States District Court for the District of Nebraska

The United States District Court for the District of Nebraska wishes to inform you of several important matters.

1.   Revised Corporate Disclosure Forms.

The court has revised the corporate disclosure form required pursuant to Federal Rule of Civil Procedure 7.1 and Federal Rule of Criminal Procedure 12.4. In addition to the information requested on the prior form, the form now also asks a party that is a limited liability entity or an unincorporated association to list its members and their states of residence. This additional information will assist the court not only in checking for conflicts but also in making diversity determinations. The revised forms are located on the court's Web page at http://www.ned.uscourts.gov/forms/ --> "Corporate Disclosure Statement." Please note that there are separate forms for civil and criminal cases.

2.   Creating an Appendix

CM/ECF Version 3.2 contains an enhancement that will allow users to compile PDF documents into a single PDF file. By selecting the new "Create Appendix" option on the docket sheet selection screen, users can select documents from the docket sheet to download as a single PDF file. Users can also automatically include either a full or abridged docket sheet. PACER fees are charged for each document selected and for the docket sheet from which the documents were selected. At present, CM/ECF cannot automatically send the Court of Appeals a Record on Appeal or an Appendix. The procedure for creating an appendix is located on the court's Web page at http://www.ned.uscourts.gov/cmecf/training.html --> "Creating an Appendix."

3.   Revised Transcript Redaction Procedure

The court will go live on CM/ECF Version 3.2 on Monday, May 12. Attorneys are urged to review the revised transcript redaction procedure mandated by the Judicial Conference of the United States Courts, located at http://www.ned.uscourts.gov/cmecf/ --> "Transcript Redaction Procedure." Please note that on May 2, 2008, the Judicial Conference revised the courts' privacy policy to now allow attorneys seven calendar days after a transcript is filed to file a notice of intent to request redaction.

NOTICE OF REAPPOINTMENT OF INCUMBENT MAGISTRATE JUDGE


The current term of the office of United States Magistrate Judge Thomas D. Thalken, who is stationed in Omaha, Nebraska, is due to expire on January 3, 2009. The United States District Court for the District of Nebraska is required by law to establish a panel of citizens to consider the reappointment of the magistrate judge to a new eight-year term.

The duties of the magistrate judge position include the following:

   (1) Conduct of most preliminary proceedings in criminal cases;

   (2) Trial and disposition of misdemeanor cases;

   (3) Conduct of various pretrial matters and evidentiary proceedings on delegation from the judges of the district court; and

   (4) Trial and disposition of civil cases upon consent of the litigants.

Comments from members of the bar and public are invited as to whether the incumbent magistrate judge should be recommended by the panel for reappointment by the Court and should be directed to;

Important Information from the United States District Court for the District of Nebraska

The United States District Court for the District of Nebraska wishes to bring several important matters to your attention.

1. CM/ECF Version 3.2

The court will go live on CM/ECF Version 3.2 on May 12. The most significant change in this version is a ninety-day restriction on remote electronic access to filed transcripts. Because the restriction period affects the ability of counsel of record to review a transcript for redaction purposes, attorneys are strongly urged to review the new transcript redaction procedure located on the court's Web page at http://www.ned.uscourts.gov/cmecf/. This change to the transcript redaction procedure will take effect on May 12.

2. Judicial Council Decisions

The Judicial Council took the following actions at its April 25, 2008, meeting: a. Agreed that proposed revisions to the local rules will be submitted annually at the January Judicial Council meeting. b. Approved the Courtroom Technology Strategic Upgrade/Replacement Plan and the Courtroom Technology Training Plan. 3. Electronic Writs

General Order No. 2008-04 "IN THE MATTER OF ISSUANCE OF CRIMINAL WARRANTS, SUMMONSES, SUBPOENAS, AND WRITS" was entered on February 27, 2008, and is located on the court's Web site at http://www.ned.uscourts.gov/pom/orders/index.html. General Order No. 2008-04 gives the clerk's office authority to sign, seal, and issue criminal warrants, summonses, subpoenas, and writs electronically. Such electronically-issued warrants, summonses, subpoenas, and writs may not, however, be served electronically. This General Order rescinds GO 2007-18.

4. Proposed Order Regarding Motion for Sentence Reduction (AO247)

A fillable PDF form for a Proposed Order Regarding Motion for Sentence Reduction (AO247) pursuant to 18 U.S.C. ?? 3582(c)(2) is available on the court's Web site at www.ned.uscourts.gov/forms. Parties are encouraged to use this form when proposing an order regarding a motion for sentence reduction pursuant to 18 U.S.C. ?? 3582(c)(2).

5. CM/ECF Training

Netscape Navigator Browser No Longer Supported

As of February 1, 2008, Time Warner's AOL ended the development and technical support of their Netscape Navigator browser. Due to this change, the U.S. District Court for the District of Nebraska will no longer test or support the use of Netscape Navigator with the court's Case Management/Electronic Case Files (CM/ECF) system. It is recommended that users switch to a current version of Internet Explorer or Mozilla Firefox.

The Nebraska Judicial Council took the following actions at its meeting on January 25, 2008:

Decided that counsel should no longer electronically file petitions to enter pleas of guilty and plea agreements before hearings. The parties must provide the court with advanced copies of the documents at least twenty-four hours before the plea hearing, and bring the originals of the documents to the hearing. Following the hearing, the documents will be uploaded into CM/ECF. As a result of the judge's decision, the "petition to enter plea of guilty and plea agreement" events have been removed from the attorney menu in CM/ECF.
Approved amendments to the Bankruptcy Court's Local Rules. The local rules will be forwarded to the Eighth Circuit for approval.

On January 16, 2008, the Administrative Office of the U.S. Courts authorized clerk's offices to keep indices of civil judgments and orders in electronic form. Users may now access judgments and orders directly from the docket sheet in PACER or at the public terminals at the courthouses. The civil judgment index report has been removed from CM/ECF.

CM/ECF Version 3.1.2. The court will go live on CM/ECF Version 3.1.2 on Monday, December 31.

In the new version of CM/ECF, three new nature of suit codes have been added. The codes and case types are:

462 (Naturalization Application)
463 (Habeas Corpus - Alien Detainee)
465 (Other Immigration Actions)


On the civil cover sheet, the "basis of jurisdiction" for these three natures of suit is 2, "U.S. Government Defendant." Access to documents in cases with these new codes is restricted to court users, case participants, and public terminal users.

Numerous performance improvements have been made to the docketing process. Users will also note improved performance when running the Docket Report for large cases.

2. CM/ECF Version 3.1. The court will go live on CM/ECF Version 3.1 on Monday, December 3. An online demonstration of the new features is available on the court's Web site at http://www.ned.uscourts.gov/cmecf/captivate/v3.htm. Two changes merit special mention: The "free peek" is now restricted to case participants. In the new version of CM/ECF, only CM/ECF case participants will receive one free look at documents via the Notice of Electronic Filing. Attorneys who have signed up to receive notice but are not case participants will be charged a PACER fee. PACER users will be allowed remote access to judgments, opinions, and orders in Social Security appeal cases. Reports and Recommendations that Article III judges adopt by orders and designate as written opinions will also be available to PACER users. In addition, the court's Web site has instructions on creating cross-document hyperlinks in both WordPerfect and Word, and an interactive module on creating the hyperlinks in WordPerfect. 3. Clerk's Office Renovation. The Omaha District Court Clerk's Office will be "closed" for renovation December 4 - December 17. The renovation will not affect CM/ECF or any court hearings or trials scheduled during this period. During the renovation, the Omaha clerk's office staff will be working at alternate locations. We will accept pleadings at the Omaha bankruptcy clerk's office, suite 1125, and you may reach Omaha clerk's office staff by e-mail or by calling (402) 661-7350.   1. To avoid potential conflicts of interest, the Nebraska Judicial Council agreed that all cases filed on the Omaha and North Platte dockets subsequent to November 2, 2007, in which Berkshire Hathaway or one of its subsidiaries is a party shall be directly assigned to Senior United States District Judge Lyle E.   2. Effective November 1, 2007, the Nebraska Judicial Council has approved an increase in transcript fee rates and added a new rate for the delivery of transcripts within14 days. See http://www.ned.uscourts.gov/pom/crtplans/courtrep.pdf > "Court Reporting Fee Schedule."

  3. Judicial Council Decisions. On October 26, 2007, the Nebraska Judicial Council:
    1. Adopted the following strategic goals: 1) By January 25, 2008, we will have a strategic plan in place to upgrade or replace all Omaha, Lincoln, and North Platte courtroom technology equipment; and 2) By January 25, 2008, we will have a strategic plan in place to assess, develop, and deliver courtroom technology training for internal and external stakeholders on all existing and newly-defined courtroom technology equipment. The goal statements are located on the court's Strategic Planning Internet site at http://www.ned.uscourts.gov/stratplan/, along with Web pages to track the progress of each new goal. (Note: The last page of the goal summary document includes a link to the July 31, 2007, strategic planning participant guide and notes. The notes from the session are located on pages 9-16, and the goals are summarized on pages 17-21.)

    2. Approved the clerk's request to issue magistrate numbers through the CM/ECF system. Original search warrant applications and affidavits, criminal complaints, and other magistrate-executed papers will be submitted to the clerk's office once the judge has signed them. Upon receipt, the clerk will open the magistrate case under seal on CM/ECF and file the paperwork. A PDF of the originals will be uploaded to CM/ECF, and the originals will be destroyed after the clerk's office holds them for 30 days to ensure quality control of the scanning. The clerk's office will scan and upload all warrants issued as sealed documents. Clerk's office staff will file warrants issued as copies under seal and will refer requests for copies of warrants to the U.S. Marshal pursuant to Nebraska Criminal Rule 9.1.

    3. Approved the clerk's request to sign, seal, and issue criminal warrants, summonses, and subpoenas electronically and adopted General Order 2007-18. See http://www.ned.uscourts.gov/pom/orders/index.html.

    4. Approved the Docket and Local Rules Committee's recommendation to adopt amendments to the local rules, and recommended to the Docket and Local Rules Committee that it consider the comments received from the Federal Practice Committee's local rules survey during its next annual review of the rules. Attorneys are invited to comment on the proposed amendments to the local rules. See http://www.ned.uscourts.gov/localrules/. Comments are due November 29, 2007.

  4. Jury Trial at UN-L Law College. Eighth Circuit Judge William Riley will try a civil case at the University of Nebraska College of Law in Lincoln on January 22, 2008. The cases that may be tried are listed in General Order No. 2007-17. See http://www.ned.uscourts.gov/pom/orders/index.html.

  5. Changes in EPA Fee Schedule. The Judicial Conference of the United States has amended the Electronic Public Access fee schedule to include court-appointed pro bono attorneys among those individuals who may, upon a showing of cause, be exempted from electronic public access fees when acting in the matter to which they were appointed. The amended schedule is available on the court's Web site at http://www.ned.uscourts.gov/info/fees.html. A link to the National Archives and Records Administration Fee Schedule is also available at the same site.

  6. Document Size Limit in CM/ECF Increased. The district court has increased the document size limit in CM/ECF from 3 megabytes to 5 megabytes. Information on how to file lengthy attachments in CM/ECF is available on the court's Web site at http://www.ned.uscourts.gov/cmecf/ > "Filing Lengthy Attachments."

  7. New Local Reports in CM/ECF. In response to attorney requests for a list of cause codes in the CM/ECF report option, the court now offers a "Cause Code List" and a "Nature of Suit List." To access the lists, log into ECF, click "Reports" on the blue menu bar, then click "Local Reports."

  8. Opening Cases in CM/ECF: Not Adding Counsel of Record. To prevent the entry of inaccurate or incomplete information when opening a civil case in CM/ECF, attorneys for plaintiffs are asked not to add counsel of record for any defendants when adding parties. The only exception to this procedure will be when the filing attorney is removing the case from state court; in this instance, the filing attorney may add counsel for the opposing party.

  9. New Civil CM/ECF Event. A new event entitled "Motion to Incur Expenses from Federal Practice Fund" has been created.

Some have said there is a perception that lawyers avoid Federal Court if possible because of the time and effort it takes to ensure compliance with the difficult local rules. Wireless Internet Access - Response requested by Monday, October 1

Members of the Federal Bar,

During the October 17, 2007, Federal Practice Committee meeting, the Committee will consider using the Federal Practice fund to pay for wireless Internet access in the Omaha, Lincoln, and North Platte courthouses. If approved, neither the Federal Practice Committee nor the court will pay for computers for attorneys to use inside the courthouses. Instead, attorneys must use their own laptops, or other appliances, such as a blackberry, to connect to the Internet.

The General Services Administration (GSA) has provided the Committee with an estimate to 1) install wireless Internet access, and 2) provide one year of access in the following locations:

Omaha - 9 courtrooms on floors 2, 3, 4 and U.S. Trustee meeting room; Lincoln - 5 courtrooms on floors 4 and 5 and GSA conference room; and North Platte - 1 courtroom on 3rd floor and GSA conference room.

GSA's estimate of $19,715.84 includes installation and one year of service. Digital Audio Files of Court Proceedings Available Online

Beginning August 6, 2007, the United States District Court for the District of Nebraska will participate in a 12-month pilot project to make digital audio files of court proceedings available to the public over the Internet through the Public Access to Court Electronic Records (PACER) system. The judges involved in the pilot are District Judge Richard Kopf, Magistrate Judge David L. Piester, Magistrate Judge Thomas Thalken, and Magistrate Judge F.A. Gossett. During the pilot, audio files of all court proceedings held in front of these judges, unless otherwise specified by the judge, will be uploaded to the Case Management/Electronic Case Files (CM/ECF) system. Attorneys of record on a case will receive a Notice of Electronic Filing for the audio file and one free download. Audio files will also be available to the public via PACER at a cost of $0.08 per file, plus the cost of accessing the docket sheet or docket activity report.

If information subject to the court's privacy policy is stated on the record, it will be available in the audio files this court makes available. (For guidance on the privacy policy as applied to documents, exhibits, and transcripts, see http://www.ned.uscourts.gov/cmecf/ --> "Notice of Electronic Availability of Case File Information"; NECivR 5.3; and NECrimR 49.3). Since counsel and the parties are solely responsible for guaranteeing that pleadings and testimony comply with the court's rules requiring redaction of personal data identifiers, the better practice is to avoid introducing personal data identifiers and other sensitive information into the record in the first place, unless absolutely necessary to prove an element of the case. The U.S. District Court Clerk's Office wishes to bring several important matters to your attention.

Chief Judge Bataillon announced that Senior Judge Thomas M. Shanahan announced his retirement to inactive status effective February 1. Judge Shanahan has served as a distinguished judge of the United States District Court for the District of Nebraska for over 13 years. In addition, he served on the Nebraska Supreme Court for ten years. We will miss Judge Shanahan's calm demeanor and sense of humor. We wish him all the best.

On January 26, 2007, the Nebraska Judicial Council:

A. Adopted the Federal Practice Committee and Civil Justice Advisory Group's recommendation to use a supplemental Jury Questionnaire, commencing in April 2007, in all civil and criminal jury trial proceedings in the United States District Court for the Nebraska. (To view the supplemental Jury Questionnaire, go to our forms page at http://www.ned.uscourts.gov/forms/) The clerk's office will distribute copies of completed questionnaires to attorneys of record at the same time it distributes the panel report, which is approximately two business days prior to trial. Attorneys may pick copies up at the clerk's office or request that the clerk's office fax the questionnaires to their office. The clerk's office will not e-mail completed questionnaires. Attorneys are required to destroy the questionnaires after trial. Any attorney who fails to destroy the questionnaires will be subject to disciplinary action.

B. Approved the Consistency Committee's recommendation to create a Web page to post judges' practices and standing recusals. The Web page is available at http://www.ned.uscourts.gov/jpar/.

C. Approved the proposed amendments to the Local Rules. The amendments, along with a summary of the amendments, are available on our Web site at http://www.ned.uscourts.gov/localrules/index.html. To comment on the amended rules, go to http://www.ned.uscourts.gov/emailus/index.html.

D. Approved the clerk's office request to destroy paper documents filed on or after January 29, 2007, thirty days after they have been scanned, verified, and subjected to quality control, unless otherwise ordered, in accordance with the Administrative Office's disposition schedule for CM/ECF records. The Council directed the clerk's office that it is no longer required to maintain the following paper documents: 1) original indictments; 2) plea agreements; and 3) petitions to enter pleas of guilty. The court's Administrative Procedures will be amended in the near future to reflect this change.

E. Adopted a General Order requiring attorneys to open their own civil cases on CM/ECF after July 2, 2007. The Council directed the clerk's office to; 1) disable the "New Cases" e-mail address; and 2) make the appropriate changes to the court's Administrative Procedures.

F. Because judges do not electronically sign a PDF document when entering text-only orders, the clerk's office changed the language in text-only orders from "Signed by Judge (name) on **/**/** to "Ordered by Judge (name) on **/**/**." The ordered date may be different from the entered date. The entered date appears on the top of notices of electronic filing as the date the system received the transaction.

G. The clerk's office has streamlined the Request for Transcript and Notice of Appeal forms. Please use the new forms, which are located on our forms page at http://www.ned.uscourts.gov/forms/.

H. Users have reported problems with pay.gov when using IE 7. If you experience any problems with pay.gov, go to Internet Options->Advanced Tab->check "Disable Phishing Filer,"-> uncheck "Warn About Certificate Mismatch,"-> uncheck "Warn if changing between secure and not secure mode." If you do not want to make these changes, we recommend that you install Mozilla Firefox as your browser.

CAMERA CELL PHONES, ELECTRICAL TESTING, PAY.GOV, and DISCLOSURE STATEMENTS

The United States District Court for the District of Nebraska wishes to inform you of the following:

Camera Cell Phones
The Nebraska Judicial Council adopted the following policy on Friday, October 27: Effective Monday, October 30, all federal government employees with agency identification, attorneys with their bar cards, and jurors who identify themselves to the Court Security Officers (CSOs) by showing a copy of their summons to appear, are permitted to enter the Omaha or Lincoln courthouse/federal building with camera cell phones. All other individuals will be directed to secure their camera cell phones in their vehicles. If that is not possible, the CSOs will store the camera phones at the security screening station.

Electrical Testing
The court's Web server and CM/ECF will be down from 8:30 a.m. to 9:30 a.m. CST on Friday, November 10, for system maintenance. Users may experience additional downtimes on November 10 between 8:00 a.m. and 5:00 p.m. due to electrical testing.

Pay.gov
As of November 23, 2006, all users accessing pay.gov must use a browser that supports 128 bit encryption. Supported versions of browsers include:

IE 6.0 (Recommended; use of IE5.5 or lower is not recommended)

Disclosure Statement
The Judicial Conference of the United States recently adopted a mandatory policy that requires courts to implement automated conflict screening. Judges must develop and update conflicts lists and use those lists in automated screening. To assist with the conflict screening process, a nongovernmental corporate party is required to file, at the outset of litigation, a disclosure statement identifying any parent corporation that owns 10% or more of its stock or to state that there is no such corporation. See Fed. R. Civ. P. 7.1 and Fed. R. Crim. P. 12.4. With the approval of the Nebraska Judicial Council, the clerk's office has created an event in CM/ECF that will allow attorneys to file these statements electronically. This filing requirement is effective immediately.  These events are found under Other Filings > Other Documents > Disclosure Statement.

Instead of paying $15.00, you now only need to pay for the cost of your lunch. The lunch buffet is approximately $6.99. Payment for lunch will be made directly to Mahoney State Park and NOT to the Federal Practice Committee as previously advised. The Federal Practice Fund will pay for the costs of the room and light refreshments. 2. On August 15, 2006, attorneys may begin opening their own civil cases in CM/ECF. The new feature will also allow attorneys to pay filing fees online with a credit card, using pay.gov. Attorneys or their staff who wish to attend training at the courthouse on the new feature may sign up at http://www.ned.uscourts.gov/cmecf/training.html. Training will also be offered at the Best Practices Forums described in paragraph 5, below.

3. In conjunction with the new case opening feature, attorneys will also have the option of electronically filing a request to issue summons, effective August 15, 2006. General Order 2006-07 authorizes the clerk's office to sign, seal, and issue summonses electronically. Attorneys may not, however, serve summonses electronically. See http://www.ned.uscourts.gov/pom/orders/index. A new Summons Requested event has been created for civil cases and can be found under Service of Process. The Administrative Procedures will be updated in the near future to reflect this change. Questions about using the event can be directed to the court's CM/ECF toll free hotline,1-866-220-4381, option 0 (Omaha), or 1-866-220-4379, option 2 (Lincoln).

4. General Order 2006-08 permits the clerk's office to refund duplicate or erroneous filing fees paid electronically with a credit or debit card. Refund requests are made by application or motion. See http://www.ned.uscourts.gov/pom/orders/index.html. Note that this order does not otherwise amend the general prohibition on refunding filing fees.

5. Openings still remain for the CM/ECF Best Practices Forums in Omaha on August 16 and September 7 and 8. For additional information or to register to attend, go to the court's Web site, http://www.ned.uscourts.gov/cmecf/forum.html.

6. The court has revised its notice of appeal forms and request for transcript forms. The revised forms can be found on the court's Web site at http://www.ned.uscourts.gov/pom/forms/index.html. Note that a new request for transcript form has been created for use by non-parties.

7. The language in order events in CM/ECF has been modified from "Order grantng/denying/etc. (motion). Signed by Judge (name) on **/**/**," to "Order granting/denying/etc. (motion) by Judge (name)." The filing date of the order is found in the Notice of Electronic of Filing (NEF) and is the same date as the judge's signed date.

8. The court's Docket and Local Rules Committee has begun its annual review of the local rules. Suggestions for amendments or additions to the rules should be sent to Therese Bollerup no later than August 25, 2006.

1. The court's CM/ECF Administrative Procedures have been revised. The procedures, along with a summary of the changes, can be found on the court's Web site at www.ned.uscourts.gov/localrules/index.html. Of particular importance is the change in language used to refer to documents subject to the E-Government Act. These documents will now be referred to as "access restricted" to differentiate them from "sealed" documents. The revised procedures are effective immediately.

2. Access to voir dire transcripts will be restricted pursuant to the E-Government Act. Counsel of record and the court will have electronic access to the unredacted transcript, but members of the public will be able to read the unredacted transcript only at the courthouse. Because voir dire transcripts will never be made remotely available, they need not be redacted.

3. Counsel are urged to remind their clients and witnesses that all persons entering the courthouses must show court security officers picture identification.

The Clerk's Office of the United States District Court for the District of Nebraska wishes to advise you of the following changes:

1. The Judicial Conference, at its March 14, 2006, session, amended the Electronic Public Access Fee Schedule for the appellate, district, and bankruptcy courts, the United States Court of Federal Claims, and the Judicial Panel on Multi District Litigation. The amendment establishes two new fees and increases the existing fee for searches by the PACER Service Center staff.

2. A fee of $.50 per-page has been established for the PACER Service Center to recoup the costs of reproducing on paper, any record pertaining to a PACER account. This fee will apply to service rendered on behalf of the United States if the record or paper relates to the requester's account and is remotely available through electronic access.

3. A fee of $45 has been established for checks that are returned to the PACER Service Center for lack of funds.

4. The Conference also amended the existing fee for searches by the PACER Service Center staff to delete "$20," and to include in its place, "For every search of court records conducted by the PACER Service Center, $26 per name or item searched."

The two new fees and the clarifying language in item four make the EPA Fee Schedule consistent with the appellate, district, and bankruptcy miscellaneous fee schedules. The fee increase will be effective on July 1, 2006.

The Clerk's Office of the United States District Court for the District of Nebraska wishes to advise you of the following changes:

1. Congress recently increased the filing fees in federal courts. Effective April 9, 2006, the fee to file a civil case in district court will increase to $350. The fee to file an appeal with a circuit court will increase to $450. Fees to file bankruptcy cases have increased as well. See Deficit Reduction Act of 2005, Pub. L. No. 109-171, ? 10001 (amending 28 U.S.C. ? 1913-1914)(Feb. 8, 2006).

2. The district court's Plans for Administration of the Federal Practice Fund and the Federal Practice Committee have been updated. The plans can be found on the court's Web site at http://www.ned.uscourts.gov/pom/crtplans/index.html.

3. The court has created a new event in CM/ECF called "Index-Continued." Experience has shown that the CM/ECF system will sometimes time out when users file an Index of Evidence with several large attachments. To avoid that problem, users can now create one or more attachments to the index, upload them to the system, then file the remaining attachments by using the "Index-Continued" event, which is found in the drop-down menu right below the "Index" event. Please keep in mind that no individual attachment may be more than 3 megabytes.

Approved the proposed amendments to the Local Rules and the revised Civil and Criminal Administrative Procedures. Following the close of a 30-day comment period, the Local Rules amendments will be sent to the Eighth Circuit for approval. Adopted a General Order allowing the clerk's office to enter text-only strike orders for incorrect PDF documents filed in CM/ECF. General Order 2005-19 is available on our Web site at http://www.ned.uscourts.gov/pom/orders/index.html.

Approved the clerk's office request to close at 4:30 p.m. rather than 4:45 p.m. The clerk's office will change its hours on December 5, 2005. With this change, all district and bankruptcy court agencies will be open for business during the same hours from 8:00 a.m. to 4:30 p.m.

Agreed that redaction requests should be filed under seal instead of mailed to the court reporter or transcriptionist. The redaction requests will be available to attorneys and parties in the case. The U.S. District Court Clerk's Office wishes to bring several important matters to your attention.

1. The U.S. District Court judges have approved General Order 2005-10, In the Matter of the Amendment of the Local Rules of Practice Regarding Ethical Standards. The General Order can be found on the courts internet site at http://www.ned.uscourts.gov/pom/orders/index.html.

2. CM/ECF Version 2.4 went into effect on April 16, 2005. Included in this version is a Written Opinions Report.

The E-Government Act of 2002 required federal courts to make written opinions available in a text-searchable format via their web sites by April 16, 2005. For the purposes of the E-Government Act, the Judicial Conference defined a written opinion as any document issued by a judge or judges of the court sitting in that capacity, that sets forth a reasoned explanation for a courts decision.

The Written Opinions Report is a free report that allows PACER users to search for these written opinions. To view the Written Opinions Report, log into CM/ECF using either your CM/ECF or PACER login and password. Click on Reports on the blue menu bar. Under Civil and Criminal Reports is the Written Opinions Report. Click on the Written Opinions Report and enter your search criteria, e.g., case number, date range, party name, etc. Only opinions entered on or after April 16, 2005, will be available on this report.

PACER users who access opinions via other reports and queries (e.g., the docket report) will not be billed for accessing the written opinion itself, but will be billed for the report or query used to identify the written opinion. For example, if a PACER user runs a docket report, the user will be charged for the docket report, as usual. If the user then clicks on the hyperlink for a written opinion within the docket report, the user will not be charged for viewing that opinion; no PACER billing receipt will appear on the screen since there is no charge. Further, viewing a document classified as a written opinion will not result in an entry in the Review Billing History Report. An entry will be made in the Billing Transaction log file with opinion in the description field and the number of pages in the page count field.

3. Also included in the new version of CM/ECF is a PDF header option that appears at the top of every page on a document viewed or printed in ECF. This header will appear in blue in the following format:

If you print the document, the header prints on the top of each page. If you wish, you can turn off the PDF header option by doing the following:

While logged into CM/ECF, go to your individual user account. Go to Utilities on the blue menu bar. Click on Maintain Your Account. On the top right-hand portion of the screen, uncheck the Add Headers to PDF Documents box. Click on submit; click on submit again. Once the box is unchecked, the header option is turned off on all documents. To turn the header option back on, follow these same steps, but check the box before clicking on submit twice.

4. A new Motion to Redact event has been added to both the criminal and civil motion lists. This event should be used if a party is asking the court for permission to redact a previously-filed document. In the motion drop down menu, the moving party should choose redact.

On January 28, 2005, the Nebraska Judicial Council:

Decided that counsel of record should have access to unredacted transcripts for the sole purpose of redaction review. Unredacted transcripts are now available at the public terminals in the Clerk's Offices and to counsel of record via PACER. The "Notice/Instructions to the Bar regarding Electronic Availability of Civil and Criminal Transcripts" has been updated to clarify who is responsible for requesting redaction. Approved a request to limit access to certain criminal documents containing personal identifiers to counsel of record and the court. For a detailed list of sealed documents limited to the court and sealed documents limited to counsel of record and the court, go to http://www.ned.uscourts.gov/cmecf/index.html, "Sealed Document List."

Approved amendments to the District of Nebraska Petition to Enter a Plea of Guilty. The amendments were necessary due to the recent Supreme Court decision in U.S. v. Booker. The updated petition is available on our internet web site at http://www.ned.uscourts.gov/pom/forms/index.html.

Approved the local rules of the U.S. Bankruptcy Court for the District of Nebraska. See General Order 2005-02 at See General Order 2005-02 at http://www.ned.uscourts.gov/pom/orders/index.html.

Approved General Order 2005-01, "In the Matter of the Revision of the Schedules of Amounts of Collateral to be Forfeited in lieu of Appearance." See General Order 2005-01 at http://www.ned.uscourts.gov/pom/orders/index.html.

In addition, a revised court reporter fee schedule is posted at http://www.ned.uscourts.gov/pom/crtplans/crtplans.html, "Court Reporting Fee Schedule." The fee schedule includes a table that allows attorneys to estimate the cost of transcripts from digitally-recorded hearings or trials.

Finally, the filing fee for civil cases increased to $250.00 on February 7, 2005.

INCREASE IN CIVIL FILING FEE - EFFECTIVE FEBRUARY 7, 2005
On December 8, 2004, the President signed into law the Consolidated Appropriations Act of 2005, which included a provision increasing the civil filing fee by $100.00, to $250.00. This change in the civil filing fee will become effective February 7, 2005, 60 days from the date the bill was signed into law by the President. The Act increased the filing fee for civil actions prescribed by 28 U.S.C. Section 1914(a) from $150.00 to $250.00. The civil filing fee was last increased in 1996 when it was adjusted from $120.00 to $150.00. The filing fee for a writ of habeas corpus will continue to be $5.00.

AVAILABILITY OF UNREDACTED TRANSCRIPTS
Unredacted transcripts are now available at the Omaha and Lincoln courthouses on the Public PCs during the five (5) day redaction period. Access at the clerk's office is subject to the normal charges for copies of those documents-10 cents per page to print from the public terminal and 50 cents to copy. Viewing without copying is free. Access from the court reporter is at the normal rate for the type of copy ordered.

PACER FEE INCREASE/TRANSCRIPTS
The Judicial Conference of the United States recently increased the fee for public access to case information from seven cents (.07) to eight cents (.08) per page, effective January 1, 2005. Beginning January 1, 2005, the fee for viewing single case reports and documents larger than 30 pages will be $2.40 (the new 30 page rate). The fee for viewing multi-case reports and transcripts will be based on the actual number of pages - there will not be a page limit. When the Notice of Electronic Filing is received after a transcript has been filed, it will state: "You will be charged for viewing the referenced documents according to the total number of pages; the usual 'free look' and 30 page limit does not apply." The user will be prompted for a PACER login and password. A PACER billing screen will be displayed showing how much the user will be billed.

NEW NATURE OF SUIT CODES
The following nature of suit codes have been added to CM/ECF:

196 - Contract: Franchise
445 - Civil Rights: Americans with Disabilities - Employment
446 - Civil Rights: Americans with Disabilities - Other
480 - Consumer Credit
490 - Cable/Satellite TV

Pursuant to the E-Government Act of 2002, Pub. L. No. 107-347 (as amended August 2, 2004) and the policy of the Judicial Conference of the United States, all documents filed in criminal cases on and after November 1, 2004, that are available to the public at the courthouse will be available to the public via the Court's electronic access system. The court reminds counsel and litigants that the Nebraska General, Civil, and Criminal Local Rules require that filing parties omit or, where inclusion is necessary, partially redact the following personal data identifiers from all pleadings, documents, and exhibits, whether filed electronically or on paper, unless the assigned judge orders otherwise.

1. Minors' names. Minors' initials shall be used.
2. Financial account numbers. The name or type of account and the financial institution where the account is maintained shall be used, but only the last four numbers of the account number shall be stated.
3. Social Security numbers. Only the last four numbers shall be used.
4. Dates of birth. Only the year shall be used.
5. Home addresses. Only the city and state shall be listed.


In addition, the filing party may omit or, where inclusion is necessary, partially redact the following confidential information from all pleadings, documents, and exhibits, whether filed electronically or on paper, unless the assigned judge orders otherwise.

1. Personal identifying numbers, such as driver's license numbers.
2. Employment history.
3. Individual financial information.
4. Proprietary or trade secret information.
5. Information which may identify an individual cooperating with the government.
6. Information regarding the victim of any criminal activity.
7. National security information.
8. Sensitive security information as described in 49 U.S.C. Section 114(s).

Text-Only Minutes and Orders ruling on Motions for Extension of Time to Answer the Complaint
Effective Monday, August 2, it is no longer necessary for attorneys to submit a proposed order ruling on a motion for extension of time to answer the complaint. Minutes from court proceedings and Orders ruling on extensions of time to answer complaints will now be filed using a text-only entry in lieu of a PDF documen t. Attorneys shall continue to submit all other proposed orders in accordance with NELR 7.1(a), 7.2, and 55.1.

If no problems arise by the end of October, routine orders that do not need a PDF document attached may also be entered with a text-only entry.

The current term of the office of United States Magistrate Judge David L. Piester, who is stationed in Lincoln, Nebraska, is due to expire on January 19, 2005. The United States District Court for the District of Nebraska is required by law to establish a panel of citizens to consider the reappointment of the magistrate judge to a new eight-year term.

The duties of the magistrate judge position include the following:

(1) Conduct of most preliminary proceedings in criminal cases; (2) Trial and disposition of misdemeanor cases; (3) Conduct of various pretrial matters and evidentiary proceedings on delegation from the judges of the district court; and (4) Trial and disposition of civil cases upon consent of the litigants.

On July 28, 2003, our court held its annual strategic planning meeting. I want to advise you of two things that came out of the meeting.

Re: Gary McFarland, Clerk of Court

Gary McFarland came to our court on July 31, 1972. He has thus served the Nebraska federal court for nearly 31 years. At the court's strategic planning meeting, our dear friend announced that he will retire as our Clerk on August 2, 2004.

Prior to his announcement, the court presented Gary with a framed general order ("In the Matter of Gary McFarland") recognizing and forever remembering his magnificent service. The court also presented Gary with a crystal gavel and granite display stand as small tokens of our affection and esteem.

So, remembering his 31 years of service and his impending retirement, when you see Gary next please join us in congratulating and thanking him. We look forward to working with him during the coming year, all the while knowing full well that Gary's contributions to the ideals of justice have been and will continue to be unmatched.

Re: Combining the Omaha and Lincoln Civil Dockets

During the strategic planning meeting, we had a spirited and lively debate among our judges. Ultimately, this is what we decided:

1. On or about August 1, 2003, we will add to the Nebraska docket: (a) cases in which the United States is the plaintiff; (b) social security appeals; (c) pro se cases including habeas corpus cases (but excluding death penalty habeas corpus and 2225 motions); and (d) bankruptcy appeals.

2. At the court's July, 2004, strategic planning meeting, we will reconsider whether to combine the Omaha and Lincoln civil dockets more broadly.

The United States District Court for the District of Nebraska highly encourages all Civil and Criminal filings to be submitted electronically. Effective January 6, 2003, the court will require that all documents submitted for filing in criminal and civil cases be filed electronically. Documents may also be submitted for filing to the Clerks' Office on 3.5"disks in .pdf ("Portable Document Format") format. After that date, conventional paper filing will require authorization by the assigned judge.

The Judicial Council recently approved another session of Survival Spanish for court employees and area attorneys. Last years participants gave high marks to the classes and the instructor, Leticia Barajas. This next session consists of an introductory level Survival Spanish class in Lincoln and a slightly advanced class in Omaha. Both classes will commence the second week of February and will run for twelve consecutive weeks.

The Lincoln class will be held from 12:00 to 1:30 p.m. on Wednesdays in the Robert V. Denney Courthouse. The Omaha class will be held from 12:00 to 1:30 p.m. on Thursdays in the Roman L. Hruska Courthouse. Similar to the initial session, classes are designed to create a culturally appropriate/sensitive environment and equip participants with the ability to communicate basic phrases and information to our Spanish speaking customers.

Generally, both classes involve the following:
  • .An introduction to the culture and basic language principles;
  • .Instruction on typical phrases (as determined by the class);
  • .Teaching materials;
  • .A one and one-half hour of group instruction per week;
  • .Opportunities to use your new found skills in real life situations; and
  • .Free of charge.

    In addition to the above, the Omaha class will focus on the practice and development of conversational ability and fluency using basic phrases. Although termed slightly advanced, participants do not need any Spanish proficiency or have participated in the initial Survival Spanish class to enroll.

    The United States District Court for the District of Nebraska is excited about offering an "experimental" course in "Survival Spanish" if Omaha court employees and lawyers are genuinely interested.

    A "Survival Spanish" course was recommended as a "positive step toward creating a culturally appropriate/sensitive environment" and that will equip court staff with the ability to communicate basic phrases and information to our Spanish speaking customers. This course will be offered in conjunction with other initiatives, such as the availability of Spanish forms and signage.

    Although all the details have not been determined, we know the course will involve:
  • An introduction to the culture and basic language principles;
  • Instruction on basic phrases (selected by the class);
  • Teaching aids and materials;
  • One hour of group instruction (per week);
  • Opportunities to use your new found skills in real life situations;
  • And be offered free (yes, libre) of charge

    We can't promise that you'll be able to order a sieta course meal (hey, this isn't so hard) in Spanish when vacationing in Cancun, but you won't have to rely on hand signals! The United States District Court Clerk's Office for the District of Nebraska wants to help you navigate through the latest technology developments in the Court. We are committed to providing you with the necessary training so you can take advantage of the new technology in the courtrooms. Additionally, we want to demonstrate electronic filing to you so you are ready to file your documents via the Internet in 2002. Lastly, we want to make your job easier by helping you navigate through our Internet website so you can find valuable resources and information with ease!     The United States District Court for the District of Nebraska has been selected as a test court for the Administrative Office's Case Management/Electronic Case Files (CM/ECF) project. CM/ECF is an Internet-based document filing system. The Court's strategic goal is to offer electronic case filing by January 2002. As we wait for the software to be released from the Administrative Office, we need your help in getting ready for this transition. If you are an attorney, paralegal, or legal assistant and want to be part of this exciting project, please contact Therese Bollerup at via our web page.
